Rubbish Collection Lambeth Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Collection Lambeth provides rubbish removal and waste collection services. By making a booking, using our services, or allowing our team to access your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection service.
1. Definitions
In these Terms and Conditions, the following words have the meanings given below:
Customer means the individual, business, organisation or other entity that books or receives the service.
Service means any rubbish collection, waste removal, clearance, loading, transportation or related work provided by Rubbish Collection Lambeth.
Waste means any items, materials, refuse, junk, furniture, appliances, garden waste, construction waste and other discarded material to be collected, subject to applicable waste regulations.
Agreement means the contract between the Customer and Rubbish Collection Lambeth for the provision of the Service, incorporating these Terms and Conditions.
2. Scope of Service
Rubbish Collection Lambeth provides waste collection and rubbish removal services for domestic and commercial customers within its operational areas. The exact nature of the Service, including type of waste, quantity, access requirements, and timing, will be agreed at the time of booking and confirmed in writing or by electronic confirmation where applicable.
The Service generally includes loading of Waste from the agreed collection point, transportation, and disposal or recycling at an authorised facility. Any additional services such as labour-intensive dismantling, packing, or extensive internal clearance may be subject to extra charges and must be agreed in advance.
3. Booking Process
3.1 Booking methods
Bookings may be made by telephone, email, online form, or other communication methods offered by us from time to time. The Customer must provide accurate and complete information about the Waste, including type, approximate volume or weight, access to the premises, and any parking restrictions or special conditions.
3.2 Quotations and estimates
Any quotation or estimate provided prior to collection is based on the information supplied by the Customer. Quotations may be given as a fixed price, price range, or price per load or unit. If on arrival the actual Waste or site conditions differ significantly from the information provided at booking, Rubbish Collection Lambeth reserves the right to adjust the price or decline the Service.
3.3 Acceptance of booking
An Agreement is formed when Rubbish Collection Lambeth confirms the booking, whether verbally or in writing, and the Customer accepts the scheduled date, time window, and pricing basis. The Customer is responsible for ensuring that contact details and collection address are accurate.
4. Access and Parking
The Customer must ensure safe, reasonable access to the Waste at the agreed time of collection. This includes, without limitation, informing us of any building access controls, stairs, lifts, narrow passageways, or potential hazards.
The Customer is responsible for arranging any necessary parking permissions, permits or visitor passes to allow our vehicles to park lawfully and reasonably close to the collection point. Any parking charges, fines, or penalties incurred due to inaccurate information or failure to secure appropriate access may be charged to the Customer.
5. Waste Types and Restrictions
Rubbish Collection Lambeth operates in accordance with applicable UK waste legislation, duty of care requirements, and environmental regulations. Certain types of Waste cannot be collected or may only be collected under specific conditions.
Prohibited or restricted items may include, without limitation, hazardous waste, clinical or medical waste, asbestos, chemicals, solvents, oils, fuel, pressurised containers, explosives, and any material classified as dangerous under relevant regulations. If you are unsure about any items you wish to dispose of, you must ask us in advance of your booking.
If our team finds prohibited items in the Waste at the time of collection, we may refuse to remove those items, adjust the price, or decline the entire Service. Any additional costs, delays, or regulatory issues arising from undisclosed hazardous or restricted material may be charged to the Customer.
6. Customer Responsibilities
The Customer must ensure that:
The Waste is owned by the Customer or the Customer has full authority to arrange its removal.
The Waste is clearly separated from items that are not to be removed.
The collection area is reasonably tidy and safe for our team to work in.
No items of value or importance are left in or among the Waste intended for disposal.
If the Customer is not present at the time of collection, adequate instructions and authorisation have been provided to allow our team to locate and remove the agreed Waste.
7. Pricing and Payment
7.1 Pricing structure
The price for the Service may be based on factors including, but not limited to, volume of Waste, weight, type of materials, time taken to load, access conditions, staffing requirements, and disposal fees. Any minimum charges or call-out fees will be explained at or before the time of booking.
7.2 Payment terms
Unless agreed otherwise in writing, payment is due on completion of the collection. We may accept payment by cash, card, bank transfer, or other payment methods notified to the Customer. For commercial customers or regular contracts, alternative payment terms may be agreed, including invoicing and credit periods, subject to credit checks and our discretion.
7.3 Late payment
If payment is not received by the due date, Rubbish Collection Lambeth reserves the right to charge interest on overdue amounts, recover reasonable costs of debt collection, and suspend further services until full payment is received.
8. Cancellations and Amendments
8.1 Customer cancellations
The Customer may cancel or reschedule a booking by giving notice as early as possible. Where cancellation is received at least 24 hours before the agreed collection time, no cancellation fee will usually apply. For cancellations made less than 24 hours before the scheduled time, Rubbish Collection Lambeth may charge a reasonable cancellation fee to cover costs incurred, including staff scheduling and travel.
8.2 Amendments
If the Customer wishes to change the date, time, location, or scope of the Service, this must be agreed with us in advance and may be subject to availability and revised pricing. We will endeavour to accommodate changes but cannot guarantee that amendments can be made at short notice.
8.3 Cancellations by Rubbish Collection Lambeth
We reserve the right to cancel or postpone a booking in the event of circumstances beyond our reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness, access issues, or safety concerns. In such cases, we will notify the Customer as soon as reasonably practicable and offer an alternative slot. We shall not be liable for any indirect loss arising from such cancellation or delay.
9. Service Delivery and Timeframes
Any times or time windows given for collection are estimates only and are not guaranteed, but we will use reasonable efforts to attend within the agreed period. Delays can occur due to traffic, access issues, or earlier jobs taking longer than expected. The Customer should ensure that someone is available during the agreed timeframe if access or instructions are required.
If we are unable to complete the Service due to circumstances within the Customer’s control, such as no access to the premises or Waste not being ready, we may charge an abortive visit fee or additional charges for return visits.
10. Waste Handling, Transport and Disposal
Rubbish Collection Lambeth will handle, transport and dispose of Waste in compliance with applicable UK waste management legislation and duty of care obligations. Waste will be taken to licensed facilities for reuse, recycling, recovery, or disposal as appropriate.
Upon collection, title to the Waste transfers to Rubbish Collection Lambeth, unless otherwise required by law. We may sort and segregate Waste materials to maximise recycling and responsible disposal. We do not guarantee that any particular item will be recycled or reused, but we aim to minimise landfill wherever reasonably practicable.
11. Liability and Limitations
11.1 General liability
Rubbish Collection Lambeth will exercise reasonable care and skill in providing the Service. Our liability to the Customer for any loss or damage arising from the Service, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the specific Service giving rise to the claim, unless otherwise required by law.
11.2 Exclusions
Rubbish Collection Lambeth shall not be liable for:
Any loss of profit, revenue, business, goodwill, or other indirect or consequential loss.
Damage to items or property that results from pre-existing defects, wear and tear, structural weaknesses, faulty installations, or items not designed to be moved or dismantled.
Loss of any items inadvertently left among the Waste if they were not clearly separated or identified to our team.
11.3 Access-related damage
The Customer is responsible for informing us of any fragile surfaces, delicate fixtures, or special precautions needed for access routes. We will take reasonable care when moving Waste through the premises, but minor scuffs, marks or wear may occur in tight or restricted spaces. Rubbish Collection Lambeth is not liable for such minor cosmetic damage where reasonable care has been exercised.
11.4 Non-excludable liability
Nothing in these Terms and Conditions shall limit or exclude any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Insurance
Rubbish Collection Lambeth maintains appropriate public liability and, where relevant, employer’s liability insurance for the Services provided. Details of insurance cover are available upon request. The Customer is responsible for arranging any additional insurance they consider necessary for items or property on their premises.
13. Complaints
If the Customer is dissatisfied with any aspect of the Service, they should contact us as soon as possible with full details of the issue. We will investigate the complaint and seek to resolve it promptly and fairly. Where appropriate, we may offer a partial refund, re-attendance, or other remedial action at our discretion, without prejudice to our legal rights and limitations of liability set out in these Terms and Conditions.
14. Data Protection and Privacy
Rubbish Collection Lambeth will collect and process personal data only as necessary for the performance of the Service, administration of bookings, and legitimate business purposes. Personal data may include contact details, addresses, and payment information. We will handle such data in accordance with applicable UK data protection laws and keep it secure and confidential, except where disclosure is required by law or necessary for service delivery.
15. Force Majeure
Rubbish Collection Lambeth shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions where such delay or failure results from events or circumstances beyond its reasonable control, including but not limited to acts of God, extreme weather, strikes, industrial disputes, breakdown of systems or equipment, power failure, or interruption of transport networks.
16. Variation of Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in law, operational practices, or service offerings. The version in force at the time of the Customer’s booking will apply to that particular Service. Customers are encouraged to review the current terms before confirming a new booking.
17. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms and Conditions, together with any specific details confirmed at the time of booking, constitute the entire agreement between the Customer and Rubbish Collection Lambeth in relation to the Service. No other statements, representations, or warranties, whether oral or written, shall form part of this Agreement unless expressly agreed in writing.
19. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms and Conditions or the provision of rubbish collection and waste removal services.
